These Terms of Service (“Terms”) govern your access to and use of DAS-DFW.com, your communications with Designed Air Solutions, LLC, and the heating, ventilation, and air-conditioning products and services provided by Designed Air Solutions, LLC (“Designed Air Solutions,” “DAS,” “we,” “us,” or “our”).
By accessing our website, requesting an estimate, scheduling an appointment, authorizing HVAC work, enrolling in our SMS program, or purchasing a product or service from DAS, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or services.
1. Our Services
Designed Air Solutions provides residential HVAC products and services, which may include:
- HVAC diagnostics and inspections
- Heating and air-conditioning repairs
- Preventive maintenance and tune-ups
- Maintenance plans
- HVAC equipment replacement
- New HVAC system installation
- Residential new-construction HVAC services
- Equipment start-up and system testing
- Indoor-air-quality and ventilation solutions
- Emergency and after-hours HVAC services
- Estimates, proposals, and system recommendations
- Warranty-related assistance
- Customer account, scheduling, billing, and service communications
The availability of individual services may depend on location, technician availability, equipment availability, weather, property conditions, licensing requirements, and other circumstances.
2. Website Use
You may use our website only for lawful purposes.
You agree not to:
- Submit false, misleading, fraudulent, or unauthorized information
- Attempt to gain unauthorized access to our website, accounts, systems, or networks
- Interfere with the operation or security of the website
- Introduce viruses, malicious code, automated scraping tools, or other harmful technology
- Use website content in a manner that infringes the rights of DAS or another party
- Impersonate another person or falsely represent your authority to request services for a property
DAS may restrict or terminate access to the website when we reasonably believe these Terms have been violated.
3. Estimates and Proposals
Unless expressly stated otherwise in writing, an estimate or proposal:
- Is based on the information and property conditions reasonably available at the time
- Is not a final invoice
- May expire on the date shown in the estimate or proposal
- May be revised if equipment costs, labor costs, taxes, permit fees, code requirements, availability, or site conditions change
- Does not include concealed, inaccessible, or previously undisclosed conditions unless specifically stated
- Is subject to equipment and material availability
Additional work may require customer approval and may result in additional charges.
If a written estimate, proposal, financing agreement, maintenance agreement, installation agreement, or other service-specific contract conflicts with these general Terms, the service-specific written agreement will control for that transaction.
4. Appointments and Scheduling
Appointment times and arrival windows are estimates. DAS makes reasonable efforts to arrive and complete work as scheduled, but timing may be affected by:
- Earlier service calls
- Emergency requests
- Weather
- Traffic
- Equipment or material availability
- Technician illness or availability
- Unsafe working conditions
- Circumstances outside our reasonable control
DAS may contact you to confirm, modify, or reschedule an appointment.
A customer or authorized adult must be available to provide access to the property unless other arrangements have been approved by DAS.
5. Customer Responsibilities
You agree to:
- Provide complete and accurate contact, property, equipment, and service information
- Confirm that you own the property or have authority to approve the requested work
- Provide safe and reasonable access to HVAC equipment and work areas
- Secure pets and remove obstacles from work areas
- Inform DAS of known hazards, including electrical problems, structural concerns, mold, asbestos, pests, water damage, or other unsafe conditions
- Provide access to necessary utilities
- Review estimates and authorize work before it begins
- Pay approved charges when due
- Follow reasonable equipment operation, safety, and maintenance instructions
DAS may stop or decline work if conditions are unsafe, illegal, inaccessible, or materially different from those represented by the customer.
6. Property Conditions and Additional Work
HVAC work may reveal concealed or pre-existing conditions that could not reasonably be identified during an initial inspection. These may include:
- Electrical or wiring defects
- Improper prior installation or repair work
- Code violations
- Drainage or plumbing problems
- Structural damage
- Inadequate ductwork
- Refrigerant leaks
- Mold, moisture, asbestos, pests, or contamination
- Inaccessible equipment or concealed components
- Equipment or materials that have been discontinued
DAS will make reasonable efforts to notify the customer before performing additional chargeable work. Additional authorization may be required.
7. Pricing, Taxes, and Payment
Prices are provided through estimates, proposals, invoices, maintenance agreements, or other written communications.
Customers are responsible for:
- Approved service and equipment charges
- Applicable taxes
- Permit or inspection fees when applicable
- Approved additional work
- After-hours or emergency charges when disclosed
- Late, returned-payment, collection, or other charges stated in an applicable agreement and permitted by law
Payment is due according to the terms shown on the applicable estimate, invoice, financing agreement, or service contract.
DAS may require a deposit before ordering equipment, scheduling an installation, or beginning substantial work.
Failure to make payment when due may result in suspension of work, cancellation of future appointments, collection activity, or other remedies permitted by the applicable agreement and law.
8. Financing and Third-Party Services
DAS may provide customers with access to third-party financing or payment options. Financing approval, interest rates, payment terms, credit decisions, fees, and account servicing are determined by the financing provider.
DAS does not guarantee financing approval or particular financing terms.
When you apply through a third-party financing provider, your application and information are governed by that provider’s privacy policy, disclosures, and agreements.
9. Cancellations and Rescheduling
Customers should notify DAS as soon as possible when an appointment must be canceled or rescheduled.
A cancellation, trip, restocking, special-order, permit, or other fee may apply when:
- The applicable estimate or agreement discloses the fee
- Equipment or custom materials have already been ordered
- Permit or administrative costs have already been incurred
- Work has begun
- A technician arrives but cannot reasonably access the property or equipment
- The customer fails to provide required notice
Any applicable fee will be governed by the written estimate, proposal, maintenance agreement, installation agreement, or other customer authorization.
10. Equipment, Parts, and Warranties
Manufacturer warranties are provided by the applicable equipment or parts manufacturer and are subject to the manufacturer’s registration requirements, exclusions, limitations, maintenance requirements, and warranty procedures.
DAS does not control manufacturer warranty decisions.
Any DAS workmanship warranty will be limited to the period and terms stated in the applicable estimate, invoice, installation agreement, or warranty document.
Warranty coverage may not apply to problems caused by:
- Misuse, abuse, neglect, or improper operation
- Failure to perform required maintenance
- Work performed by another company or unauthorized person
- Electrical surges, utility problems, fire, flooding, severe weather, pests, or other external causes
- Alterations to equipment or controls
- Pre-existing or concealed conditions
- Customer-provided equipment or materials
- Manufacturer exclusions
- Failure to pay amounts due
DAS does not guarantee that a repair will prevent every future equipment failure or that maintenance will eliminate all breakdowns.
11. Maintenance Plans
Maintenance-plan benefits, pricing, covered equipment, renewal terms, exclusions, discounts, scheduling priority, giveaways, and termination rights are governed by the applicable maintenance-plan agreement.
Unless the maintenance-plan agreement expressly states otherwise:
- Maintenance does not include repairs, replacement parts, refrigerant, or equipment replacement
- Discounts apply only to eligible services
- Benefits may not be transferred between customers or properties
- The plan must remain current and paid to receive benefits
- Scheduling priority does not guarantee immediate or same-day service
If there is a conflict between these Terms and a written maintenance-plan agreement, the maintenance-plan agreement controls.
12. Energy Savings and Performance
Any discussion of potential comfort improvement, energy savings, efficiency, equipment life, or performance is an estimate and not a guarantee.
Actual results depend on factors that may include:
- Weather
- Utility rates
- Thermostat settings
- Occupancy
- Building construction and insulation
- Ductwork
- Existing equipment and controls
- Maintenance
- Customer behavior
- Conditions outside DAS’s control
13. SMS Terms of Service
Consent to Receive SMS Messages
If you consent to receive SMS messages from Designed Air Solutions, you agree to receive conversational, account-notification, informational, and—when separately authorized—marketing SMS messages from DAS.
Messages may include:
- Responses to customer questions
- Appointment scheduling
- Appointment confirmations and reminders
- Technician-arrival notifications
- Estimate and proposal follow-ups
- Installation, repair, and maintenance updates
- Account and service notifications
- Invoice and payment reminders
- Post-service surveys
- Maintenance-plan information
- Seasonal HVAC reminders
- Promotional offers
- Information about DAS products and services
Marketing Consent
DAS will send marketing or promotional SMS messages only after obtaining the required consent.
Consent to receive marketing SMS messages is not a condition of purchasing any product or service from Designed Air Solutions.
Message Frequency and Charges
Messaging frequency may vary depending on your service activity, account status, communication preferences, and participation in promotional messaging.
Message and data rates may apply according to your wireless-service plan. Wireless carriers are not responsible for delayed or undelivered messages.
Opting Out
You may stop receiving SMS messages at any time by replying STOP.
After opting out, you may receive one final message confirming that your request has been processed. You will not receive additional SMS messages unless you subsequently request or consent to receive them again.
You may also withdraw consent through another reasonable method, including calling 214-550-3869 or emailing customerservice@das-dfw.com.

14. Telephone Calls and Electronic Communications
By contacting DAS or providing contact information, you authorize us to respond through reasonable communication methods, subject to applicable consent requirements and your communication preferences.
Telephone calls may be monitored, recorded, transcribed, or analyzed for customer service, training, quality assurance, documentation, and safety purposes when permitted by law.
DAS may use customer-service technology, artificial intelligence, or automated tools to assist with scheduling, call handling, communication, quality assurance, or service support.
15. Intellectual Property
The DAS website and its content—including logos, graphics, designs, photographs, text, slogans, videos, and other materials—are owned by or licensed to Designed Air Solutions and are protected by applicable intellectual-property laws.
You may use the website for personal, noncommercial purposes related to evaluating or purchasing DAS services.
You may not copy, reproduce, modify, distribute, sell, publish, or commercially use DAS content without written permission.
16. Third-Party Websites
Our website may contain links to third-party websites, including payment processors, financing providers, manufacturers, social-media platforms, or other service providers.
DAS does not control and is not responsible for independently operated third-party websites, content, security, availability, terms, or privacy practices. Your use of a third-party service is governed by that party’s policies and agreements.
17. Disclaimer of Website Warranties
The DAS website is provided on an “as available” basis. To the fullest extent permitted by law, DAS does not warrant that:
- The website will always be available or error-free
- Website information will always be complete or current
- Electronic communications will always be secure or uninterrupted
- Website content constitutes a final HVAC diagnosis, estimate, or professional recommendation
Website information is general in nature and is not a substitute for an on-site HVAC inspection when one is reasonably required.
Nothing in these Terms excludes a warranty or right that cannot legally be excluded.
18. Limitation of Liability
To the fullest extent permitted by applicable law, DAS will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, delayed communications, third-party services, or circumstances outside our reasonable control.
Any limitation of liability relating to HVAC products or services will also be governed by the applicable estimate, invoice, installation agreement, maintenance agreement, warranty, or other written contract.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Indemnification
To the extent permitted by law, you agree to be responsible for losses, claims, or expenses arising from:
- Your unlawful misuse of the website
- Information you knowingly provide without authorization
- Your violation of these Terms
- Your infringement of another person’s rights
This section does not require a customer to indemnify DAS for DAS’s own negligence or unlawful conduct.
20. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal proceeding concerning these Terms that is not otherwise governed by a separate written agreement must be brought in a court of competent jurisdiction in Texas, subject to applicable law.
21. Changes to These Terms
DAS may update these Terms periodically to reflect changes in our services, business practices, technology, or legal requirements.
Updated Terms will be posted on our website with a revised “Last Updated” date. Changes apply prospectively unless otherwise required by law.
22. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
23. No Waiver
A failure by DAS to enforce a provision of these Terms does not waive the right to enforce that provision later.
24. Entire Agreement
These Terms, our Privacy Policy, and any applicable estimate, proposal, invoice, maintenance agreement, installation agreement, financing agreement, warranty, or other written authorization constitute the agreement applicable to the particular interaction or transaction.
